Different calls.
Different protections.

The TCPA covers several kinds of communications. Find your situation below to learn what matters and what evidence to keep.

More about your rights
Does a call have to be recorded to violate the TCPA?
No. A live sales call may raise a Do Not Call issue. Prerecorded or artificial-voice restrictions and qualifying autodialer restrictions are separate protections. The applicable rule depends on the communication and your circumstances.
Do I have to be on the Do Not Call list?
Not for every type of claim. Registry-based protections depend on registration, but other TCPA provisions may apply to recorded or artificial-voice calls, qualifying autodialed calls or texts, and unsolicited fax advertisements. Consent and exceptions matter.
Can I have a case if the calls are for someone else?
Possibly. Repeated prerecorded or artificial-voice calls intended for another person can raise TCPA issues. Consent, the type of call, the phone line, and any applicable exceptions matter. Save the messages and let an attorney evaluate the facts.
Does every unwanted call violate the TCPA?
No. The law treats different types of calls and messages differently. Consent, technology, the purpose of the communication, and exemptions can affect whether a claim exists. An annoying call alone does not establish a violation.
What should I save before contacting you?
Keep original voicemails, text messages, screenshots, and call logs. Write down company names, dates, the person they asked for, and any request you made to stop. Keep proof of when you obtained your number. Do not record live calls without first checking the applicable recording laws.
What could compensation look like?
For certain TCPA violations, the statute allows actual monetary loss or $500 per violation, whichever is greater. A court may increase that amount up to three times for knowing or willful violations. Eligibility and recovery depend on the facts; no result is guaranteed.
Does a case review cost anything?
The initial case review is 100% free. If the firm offers representation, the scope of work and any fees or costs will be explained in a separate agreement. Submitting a request does not create an attorney-client relationship.
